FAIR Plan or surplus lines application completed
How this closesHand in your document — Submitting it closes this step. We keep a copy for your record — we never file or submit anything for you.
Why this matters
When the ordinary market will not write you, these two routes are what is left, and they are real cover rather than a consolation prize. Businesses across this corridor are operating on them right now. What catches people out is assuming either one is a straight substitute for the policy they lost. Neither is, and knowing exactly what each does and does not do before you sign is the whole of this step.
The application is also not a formality. The same property can be quoted very differently depending on how well the submission is prepared, because an underwriter who cannot see your mitigation assumes you have none.
Before you start
Both routes are placed through a licensed broker rather than applied for directly, so your first job is the right broker rather than the right form. A surplus lines placement in particular has to go through a broker licensed for it.
Understand the two shapes before you choose. The California FAIR Plan is a basic property policy focused on fire, with maximum limits set by the Plan, and it does not provide the breadth of a standard commercial package, including liability. Businesses commonly pair it with a separate difference in conditions policy covering what the FAIR Plan leaves out. The Plan’s commercial limits have been changed more than once and should be checked as they stand today. Not yet confirmed by LAEDC.
And the surplus lines trade-off: surplus lines carriers are non-admitted in California, meaning they are not backed by the California Insurance Guarantee Association if the carrier becomes insolvent, and surplus lines placements carry a premium tax and stamping fee on top of premium. Not yet confirmed by LAEDC. In exchange you get flexibility on risks nobody else will take.
The rest of this step is for LAEDC clients
